Terms of Service

These Terms govern your use of our online quoting platform and custom 3D printing services. Please read them carefully.

1. Acceptance of these Terms

Welcome to DEVHAUS 3D Print ("DEVHAUS", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, online quoting tool, account features, and related services (collectively, the "Services").

By creating an account, uploading files, requesting a quote, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms from time to time. The "Last updated" date at the top of this page will change when we do. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

The Services are intended for adults. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and place orders. By using the Services you represent that you can form a binding contract and that your use complies with applicable Australian and local laws.

3. Your Account

Certain features require an account. You must provide accurate and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may suspend or terminate access if we reasonably believe you have breached these Terms, misused the Services, or engaged in unlawful activity. You may delete your account through the account settings (or by contacting us). Account deletion may remove associated data subject to legal retention requirements — see our Privacy Policy.

4. Acceptable Use

You agree that your use of the Services, including any files you upload and any orders you place, will not:

  • Involve weapons, firearm components, ammunition, or items designed to function as weapons (including realistic replicas intended to deceive);
  • Infringe any third-party intellectual property or other legal rights;
  • Contain unlawful, fraudulent, harassing, defamatory, or otherwise prohibited content; or
  • Violate export controls, sanctions, or other applicable laws.

We may refuse, cancel, or delete orders and content that we reasonably believe violate this policy, without liability to you beyond any refund required by law.

5. Intellectual Property

All website content, branding, software, and documentation provided by DEVHAUS remain our property or that of our licensors. You may not copy, modify, or redistribute our materials except as expressly permitted.

Your files. You retain all intellectual property rights in CAD files, models, and designs you upload. You grant us a limited licence to store, process, slice, and manufacture from those files solely to provide quotes and fulfil your orders. We will not use your designs for our own products or disclose them to third parties except as needed to operate the Services (e.g. cloud hosting) or as required by law.

You warrant that you have the right to upload and commission manufacture of your designs, and that doing so will not infringe third-party rights. You indemnify us against claims arising from breach of that warranty.

6. Pricing and Quotes

Instant quotes are estimates based on the configuration and geometry data available at the time of estimation. Prices are shown in Australian dollars (AUD) and are GST-inclusive unless otherwise stated.

We may revise or cancel a quote before order confirmation if files are incomplete, not manufacturable as configured, or if there is an obvious pricing error. Large-format and manual-review jobs are subject to engineering review and a custom quote before production begins.

Material availability, machine capacity, and pricing configuration may change. Binding price for an order is the amount confirmed at checkout (or in a written custom quote you accept).

7. Payment

Payments are processed securely by Stripe. We do not store full card numbers on our servers. By placing an order you authorise payment of the confirmed amount. Production typically begins after successful payment (or as otherwise agreed for custom jobs).

8. Delivery and Pickup

Delivery options may include Canberra pickup and Australia-wide shipping. Estimated lead times and delivery dates are indicative only; we will use reasonable efforts to meet them but are not liable for carrier delays beyond our control.

You are responsible for providing a correct delivery address. Risk in goods passes on delivery to the carrier or on pickup, as applicable. Any import duties or taxes outside Australia (if applicable) are your responsibility.

9. Returns, Refunds and Australian Consumer Law

Goods are custom-manufactured to your specifications. Change-of-mind returns are generally not available. If a part has a manufacturing defect caused by us, contact us promptly with photos and order details and we will repair, replace, or refund as appropriate.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) that cannot be excluded. Where we are permitted to limit liability for a failure to comply with a consumer guarantee, our liability is limited to resupply of the services or payment of the cost of resupply, at our option.

10. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, the Services are provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, or that every uploaded file will be auto-quotable.

Subject to the Australian Consumer Law and any non-excludable rights, we are not liable for indirect, incidental, special, or consequential loss (including lost profits or business opportunity). Our aggregate liability relating to any order is limited to the amount you paid for that order.

11. Third-Party Services

The Services rely on third-party providers (including hosting, identity, payments, and email). Your use of those providers may be subject to their terms. We are not responsible for third-party services outside our reasonable control.

12. Termination

We may suspend or terminate your access for breach of these Terms or for operational or legal reasons. On termination you must stop using the Services. Provisions that by nature should survive (including IP, indemnities, limitations of liability, and governing law) will survive.

13. Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia. The parties submit to the non-exclusive jurisdiction of the courts of the ACT and courts of appeal from them.

14. General

If any provision of these Terms is held invalid, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and DEVHAUS regarding the Services and supersede prior agreements on the same subject.
